Welcome to Grain Hauler Hub (“we”, “us” or “our”). These terms and conditions (the “Terms”) govern use of Grain Hauler Hub at https://grainhaulerhub.com and the services provided therein. By accessing or using Grain Hauler Hub, creating a user account, submitting a report, or using any Grain Hauler Hub service, users agree to these Terms.

1. Acceptance of Terms

By accessing and using Grain Hauler Hub, users confirm that they have read, understood and agree to be bound by these Terms and any additional policies referenced herein.

Use of Grain Hauler Hub is also subject to our Privacy Policy, available at https://grainhaulerhub.com/privacy-policy, which is incorporated by reference into these Terms.

2. Scope of Services

Grain Hauler Hub provides publicly accessible facility information and driver-submitted reports solely for informational purposes intended to enhance transparency and visibility within the grain transportation network across Western Canada.

Grain Hauler Hub is an informational platform and does not function as a dispatcher, carrier, broker, grain company, elevator operator, safety authority, or transportation authority.

Grain Hauler Hub may be unavailable, interrupted, delayed, or changed at any time. Grain Hauler Hub does not guarantee uninterrupted access, error-free operation, or permanent availability of any feature or data.

3. Access and Use

Certain features of the platform require the creation of a user account. Users agree to provide accurate and complete account information, maintain the confidentiality and security of their login credentials, refrain from sharing account access with unauthorized persons, promptly notify Grain Hauler Hub of any suspected unauthorized use or access, and utilize the platform in accordance with all applicable laws and regulations.

Grain Hauler Hub reserves the right, in its sole discretion, to suspend, restrict, or terminate user accounts at any time if it determines, in its reasonable judgment, that an account has been misused, compromised, or poses a risk to the integrity, security or proper functioning of the platform or other users.

4. Driver Reports

Drivers may submit reports regarding facility activity, queue status, wait times, or related observations to https://grainhaulerhub.com.

By submitting reports, comments, corrections, or other content, the user hereby grants Grain Hauler Hub a non-exclusive, worldwide, royalty-free license to use, display, store, reproduce, modify, create derivative works of, summarize, collect, and distribute such content solely for the purposes of operating, improving, promoting, and protecting the platform and its services.

By submitting a report, the user affirms that the report provided is based on the user’s honest and accurate observation, and that it is not intentionally false, misleading, or deceptive. The user further agrees that the report shall not contain confidential, abusive, defamatory, threatening, or unlawful content, and consents to its potential display, summarization, collection, or use by Grain Hauler Hub.

Grain Hauler Hub reserves the right, at its sole discretion, to remove, edit, hide, or restrict access to any reports at any time and for any reason.

5. User Privacy

Grain Hauler Hub is committed to respecting the privacy of drivers. Accordingly, the platform is designed so that drivers' first names and last names are not publicly displayed in connection with reports.

Users are to refrain from including any personal, private, confidential business information, or identifying details regarding themselves or third parties in report comments or submissions.

6. Limitations of Information

Driver-submitted reports are community-generated observations and shall not be interpreted as official, authoritative, or binding information.

These reports do not constitute official facility dispatch data, guaranteed wait times, formal facility performance metrics, official instructions from any grain company or elevator, routing guidance, safety clearance, legal advice, or regulatory guidance.

Users should independently verify all critical information directly with the relevant facility, dispatcher, carrier, customer, or other appropriate entity prior to making any operational, safety, or regulatory decisions.

7. No Guarantee of Accuracy

Grain Hauler Hub makes reasonable efforts to provide accurate and useful information; however, it does not warrant, represent, or guarantee that any information available on the platform is accurate, complete, current, or suitable for any particular purpose.

Given the dynamic nature of facility activity, wait times, queue statuses, access conditions, hours of operation, and other related information are subject to change and may become outdated or inaccurate without notice. Users acknowledge and agree that reliance on any information provided by Grain Hauler Hub is at their sole risk, and Grain Hauler Hub shall not be liable for any inaccuracies, omissions, or outdated information.

8. Acceptable Use

Users agree not to submit, upload, or transmit any false, misleading, abusive, defamatory, or unlawful content. Users shall not impersonate any individual or organization, interfere with the proper functioning of the platform, attempt unauthorized access to the platform or related systems, engage in data scraping or harvesting without prior permission, or harass, threaten, or target any individual, driver, facility, company, or organization.

Furthermore, users shall not upload or introduce malicious code or software, nor use Grain Hauler Hub for any unlawful, unsafe, or otherwise prohibited purposes. Users shall comply with all applicable laws, regulations, and these Terms at all times.

9. Safety Management and Compliance

Users bear sole responsibility for all driving, routing, loading, unloading, communication, safety, and operational decisions. Grain Hauler Hub’s information is provided for informational purposes only and is not a substitute for direct communication with facilities, instructions from dispatchers, carrier policies, customer directives, applicable road laws, safety regulations, or professional judgment.

Users agree to comply with all applicable laws, regulations, site-specific rules, traffic laws, safety procedures, and carrier requirements at all times. Grain Hauler Hub shall not be held liable for any operational or safety decisions made by users.

10. Disclaimer of Affiliation

Grain Hauler Hub may display information regarding facilities, companies, locations, and related data obtained from public sources, user submissions, company submissions, or internal research.

The inclusion of any facility, company, or location in the platform shall not be interpreted as an endorsement, approval, partnership, verification, or certification by Grain Hauler Hub, unless explicitly stated otherwise.

Facility owners, companies, or authorized representatives may contact Grain Hauler Hub to request corrections, updates, or removal of information, which Grain Hauler Hub may, at its sole discretion, consider and act upon.

11. Not a Substitute for Professional Advice

The information provided on Grain Hauler Hub is intended solely for general informational purposes and shall not be construed as legal, financial, transportation, safety, dispatch, agricultural marketing, or operational advice. Grain Hauler Hub does not warrant or guarantee the accuracy, completeness, or applicability of such information for any specific use or circumstance. Unauthorized use, reproduction, distribution, modification, or creation of derivative works based on Grain Hauler Hub content or software is strictly prohibited without prior written consent, except to the extent permitted by applicable law.

14. Disclaimer of Warranties

Grain Hauler Hub is provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, Grain Hauler Hub disclaims all warranties, representations, and conditions, whether express, implied, statutory, or otherwise, including but not limited to warranties of accuracy, reliability, merchantability, fitness for a particular purpose, non-infringement, availability, and security.

15. Limitation of Liability

To the fullest extent permitted by applicable law, Grain Hauler Hub and its owners, operators, employees, contractors, service providers, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to damages arising from or related to the use or inability to use the platform, reliance on driver-submitted reports, inaccuracies or outdated information, operational, routing, or safety decisions, lost profits, loss of business, loss of data, service interruptions, unauthorized access, or third-party services.

Users acknowledge and agree that their use of the platform is at their own sole risk and discretion.

16. Indemnity

Users hereby agree to defend, indemnify, and hold harmless Grain Hauler Hub and its owners, operators, employees, contractors, service providers, and affiliates from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

(a) the user’s use of the platform;

(b) submitted reports, content, or information;

(c) any breach or violation of these Terms;

(d) any violation of applicable law;

(e) misuse of platform information; or

(f) infringement of the rights of any third party.

17. Suspension or Termination

Grain Hauler Hub reserves the right, in its sole discretion, to suspend, restrict, or terminate any user’s access to the website or any account at any time and without prior notice, if it determines that the user has violated these Terms, engaged in conduct that poses a risk to the platform or other users, abused the service, or otherwise used the platform in a manner deemed inappropriate or unlawful.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Saskatchewan and the laws of Canada applicable therein. Users agree that any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts or tribunals located in Saskatchewan, unless otherwise required by applicable law.

19. Modifications

Grain Hauler Hub reserves the right to modify, revise, or update these Terms at any time and at its sole discretion. Any such updates will be posted on the website with a revised effective date. Continued use of Grain Hauler Hub following the posting of any modifications shall constitute the user’s acceptance of such updated Terms.
